SHIFTING PICTURES INC., doing business as THE INTERPRETER’S LAB, (“Company”, “we”, “us” or “our”) collects, uses, processes, discloses and retains your personal information and data when you access or use the Company’s website or services. This Privacy Policy (“Policy”) discloses the privacy practices for www.interpreterslab.org (the “Website”) of the Company, as well as related products and services the Company may offer to you which include but are not limited to, interpreter education, professional development and career guidance (the “Services”).

This Policy explains how personal data and other information that the Company receives or collects about you may be used.  The term “you” or “User” refers to any individual that accesses or uses the Website or purchases or uses any of the Company’s Services. In this Policy, the Company also explains our privacy practices and how the Company collects information, including your rights as Users.

This Policy, your access to and use of the Website and/or our Services will be governed by British Columbia law.

DATA COLLECTED

In order to better provide you with the Website and Services, the Company may collect two types of information about Users: personal data that lets us know the specifics of who you are or as otherwise defined under applicable law (“Personal Data”), and aggregate information, which does not by itself identify you but is a collection of information related to a collective of Users (“Aggregate Information”). Note that while you determine whether to disclose Personal Data to us, if you elect not to do so, we may not be able to provide you with the full User experience and/or the Services.

The data we may collect includes:

Personal Data: voluntarily provided information which may include your name, address, phone number, email address, login name and password, location data, device and network information such as IP address, browser type, unique device identifiers, other information that you provide us through your user account; or
  2. Aggregate Information: non-personal anonymous demographic information, transaction-related information relating to the types of products or services requested or provided, order details, delivery information, amounts charged, payment methods, customization services, information about returns or exchanges, communication information when you communicate with us or other information automatically collected when visiting our Website or using our Services, which may include cookies, third party tracking technologies and server logs.

The Company and third-party service providers use cookies or other tracking tools to better provide you with the Services, in addition to any other purposes described in this Policy or any other policy we may publish on the Website from time to time.

COLLECTION METHOD AND PURPOSE

The Company uses Personal Data you provide to us, for example by way of surveys and/or other online forms you complete, using or viewing our website via your browser’s cookies, emails you send us, provide feedback on any of our message boards, or signups for newsletters, giveaways or contests for various purposes. The Company and/or associated third-party providers may collect Aggregate Information, such as the collection of your IP address to diagnose system errors or to administer our Services.

DATA TRANSFERS AND RETENTION

The Personal Data the Company collects may be transferred to and stored or otherwise processed in Canada and/or in the United States.  The Company may transfer Personal Data to service providers that process personal data in Canada and/or in the United States.

The Company retains Personal Data in accordance with applicable Canadian law. The Company will not retain Personal Data longer if such data is no longer needed for the purpose that it was collected.

For example:

  1. Personal Data collected for purposes related to the performance of a contract between you and the Company will be retained until such contract has been fully performed; and
  2. Personal Data collected for the purposes of the Company’s legitimate interests will be retained as long as needed to fulfil such purposes. You may find specific information regarding the legitimate interests pursued by the Company within the relevant sections of this document or by contacting the Company.


The Company may retain Personal Data for a longer period if:

  1. you provide such consent to the Company; or
  2. the Company is required to do so for the performance of a legal obligation.


The Company will delete your Personal Data when it is no longer required for its intended purpose or when the Company is not legally obligated to retain such data. Your right to access, request erasure, request rectification and data portability cannot be enforced once the Company deletes such data.

AGE OF MAJORITY

The Company does not provide Services to individuals under the age of 18. You represent that you are the age of majority in the jurisdiction of your residence.

DISCLOSURE OF INFORMATION

The Company will not use or disclose your Personal Data except in accordance with this Policy or under the following circumstances:

  1. as necessary to provide Services to you;
  2. as otherwise described in this Policy or to which you have consented;
  3. as required by law;
  4. to auditors which agree to keep the data confidential;
  5. as necessary to enforce the Terms of Use, other policies and regulations in accordance with this Website and Services; and
  6. as necessary to maintain, safeguard and preserve all the rights and property of the Company.


MARKETING AND SUBSCRIPTIONS

If you subscribe to our newsletter, our Company may use your Personal Data to send information to you about our products and/or Services that might interest you.

You may discontinue receiving any emails or newsletter communications from the Company by unsubscribing or opting out of any such communication.

THIRD PARTY APPLICATIONS OR WEBSITES

The Website may include links to other applications or websites that are controlled by third parties. The Company does not monitor or control any such third-party provider, and we are not responsible for any of the content, user terms, or privacy policies for such applications and/or websites. You are strongly advised to read the terms and policies of all applications and websites prior to visiting same.

As of the date of this Policy, the third-party service providers include but are not limited to the following:

  2. Stripe (https://stripe.com/en-ca);


NON-CANADIAN USERS

Privacy of Children: The Company does not provide Services to children. The Website and Services are intended for people who are at least 18 years of age. The Company will not knowingly collect personal information from any child under the age of 13. The Company asks that minors (under the age of 18) not use the Website or Services. If a child under the age of 13 has provided us with personal information, a parent or guardian of that child may contact us and request that such information be deleted from our records and termination of the corresponding account.

California Privacy Rights: If you are a California resident, then you may request that the Company not share your Personal Data and Aggregate Information with third parties for direct marketing purposes. We do not sell your personal information. The Company will not discriminate against any User for exercising their rights under the California Consumer Privacy Act. California residents that wish to opt-out should email their written request to [email protected] and provide us with 30 days to process the request.

Notice to European Union Users: This Policy and its enumerated policies are intended to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “General Data Protection Regulation” or “GDPR”) and provide appropriate protection and care with respect to the treatment of your personal information in accordance with the GDPR. The Company will not process your User information without a lawful basis to do so, as such basis are defined in Article 6 of the GDPR. In general, the Company will process your information on the legal basis of consent, contract (if you have entered into an agreement with us and such processing is a necessary part thereof), or legal obligation (as noted above). The Company may also process certain information on the basis of the following legitimate interests, provided that such interests are not overridden by your privacy rights and interests: developing and improving the Website and/or Services, conducting research from your behaviour on the Website (e.g., analyzing traffic, and providing a stable, consistent, and secure experience in connection with the Website).

Notwithstanding the foregoing, and any other provision in this Policy, while the Company makes reasonable efforts to comply with various international regulations and legislation applicable to its Users, you acknowledge and agree that the Website and Services are provided by a Canadian company, and primarily targeted to a Canadian userbase. If you are not a Canadian resident, while your access and use of this Website is at your own risk, the Company will make reasonable efforts to accommodate your privacy concerns and requests. SECURITY

When you submit sensitive information through the Website your information is encrypted. Computers and servers that contain personally identifiable information are kept in a secure location.

Your Personal Data may be accessed by and/or transmitted to employees to perform a task related to the Website or Services.

You should protect against unauthorized access to your user account password and devices. You should sign out of your user account after each use.

YOUR DATA PROTECTION RIGHTS

You have the right to the following data protection rights:

  2. to request correction of any information you believe is inaccurate;
  3. to complete the information you believe is incomplete;

We may charge you a fee to provide you with copies of your personal data.

The Company may, in its sole discretion, make changes to this Policy at any time. If the Company makes minor changes, it will notify you by revising the date on the top of this Policy. If the Company makes a material change to this Policy, then the Company will notify you in writing or place a statement on the homepage of the Website.
